Ordinance No. 207A – Indemnification

INDEMNIFICATION OF OFFICERS AND EMPLOYEES OF THE CITY OF WABASSO

THE CITY COUNCIL OF WABASSO DOES ORDAIN:

1. The governing body of the city of Wabasso shall defend, save harmless and indemnify n any of its officers and employees, whether elective or appointive and including its police officers against any tort claim or demand, whether groundless or otherwise, arising out of an alleged act or omission occurring in the performance of duty.
2. EXCEPTIONS. The provisions of this ordinance do not apply in cases of malfeasance in office or willful or wanton neglect of duty.

This ordinance does not repeal or modify Minnesota Statutes 1961, Sections 471.44 and 471.45 insofar as if judgement be rendered against a police officer, the council shall appropriate moneys from any funds available to pay such judgement.

3. SEVERABILITY. If any section, clause, provision, or portion of this ordinance is adjuged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby.
4. This ordinance becomes effective from and after its passage and publication.
