AN ORDINANCE PROHIBITING OPEN BURNING IN THE CITY OF WABASSO
THE CITY COUNCIL OF THE CITY OF WABASSO HEREBY ORDAINS:
Section 1. Open burning Prohibited. From and after the effective date of this ordinance, except as herein otherwise provided, open burning shall be prohibited within the City of Wabasso.
Section 2. Exemptions. Open burning of the types, and subject to the conditions, as hereinafter stated, shall be exempt from the prohibition of Section 1 of this ordinance:
- A fire contained in a charcoal grill, camp stove, or other device designed for the purpose of cooking or heating;
- Fires under managed supervision purposely set for the instruction and training of public and industrial firefighting personnel for which a burning permit has been obtained from the Department of Natural Resources.
Section 3. Penalties. Violations of any of the provisions of this ordinance shall be petty misdemeanors. The third violation and all subsequent violations within a one year period of time shall constitute a misdemeanor.
Section 4. Repeal. Ordinance No. 221 entitled “Ordinance Authorizing the Open Burning of Leaves” dated November 7, 1984, as amended, is hereby repealed.
Section 5. Effective date. This Ordinance becomes effective upon its passage and publication according to law.
