Ordinance No. 222 – Urban & Rural Service Districts

AN ORDINANCE DIVIDING THE CITY OF WABASSO INTO URBAN SERVICE DISTRICT AND RURAL SERVICE DISTRICT

            The City Council of the City of Wabasso, Minnesota, does ordain as follows:

            Section 1. Division of City into Districts.

            The city of Wabasso hereby divides the area within its limits into an Urban Service District and a Rural Service District, constituting separate taxing districts for the purpose of the municipal property taxes except those levied for the payment of bonds and judgements and interest thereon.

            Section 2.  Urban Service District Defined.

            The Urban Service District shall include all properties within the limits of the City of Wabasso, except those set forth by ordinance as the Rural Service District.

            Section 3. Rural service District Defined.

            The Rural Service District shall include only such unplatted lands which need not be contiguous to one another as in the judgement of the City Council at the time of adoption of the ordinance are rural in character, and are not developed for commercial, industrial, or urban residential purposes and for those reasons are not benefitted to the same degree as other lands by municipal services financed by general taxation. This ordinance may include lands outside of the City of Wabasso which if annexed shall be included in the Rural Service District.

            Section 4. Description of Lands Included in Rural Service District.

            The following lands are included in the Rural Service District:

RURAL SERVICE DISTRICT A: The Southeast One Quarter (SE ¼) of the Northwest One Quarter (NW ¼) of Section Twenty Three (23) Township One Hundred Eleven (111) North Range Thirty Seven (37) West; AND the South one Half of the Northeast Quarter (S ½ NE ¼ ) of Section Twenty Three (23) Township Number One Hundred Eleven (111) North of Range Thirty Seven (37) West of the Fifth Principal Meridian EXCEPTING THEREFROM the following described tract: Commencing at a point on the Eat line of the Northeast Quarter (NE ¼ ) of Section Twenty Three (23), Township One Hundred Eleven (111)North of Range Thirty Seven (37) West of the Fifth Principal Meridian, Redwood County, Minnesota, Four Hundred Seventy (470) feet North of the Southeast Corner of the Northeast Quarter (NE ¼ )and running thence due West One Hundred Sixty Five (165) feet, thence due North One Hundred (100) feet, thence due East One Hundred Sixty Five (165) feet, and thence South to place of beginning, with right of reversion as more fully set out in that Warranty Deed dated September, 29, 1936, filed October 8, 1936 in Book 88 of Deeds on page 347 AND EXCEPTING THEREFROM the following described tract: Beginning at a point 885.8 feet West of the Southeast Corner of the said Northeast Quarter (NE ¼ ) running thence West a distance of 195 Feet; Rural Service District B: Outlots J,K,L,M and N situated in the Subdivision entitled “Blocks 22 to 28 Inclusive and Outlots “A” to “R” Inclusive to the Town of Wabasso”, in the City of Wabasso, Redwood County, Minnesota.

RURAL SERVICE DISTRCT C: Outlots O and P situated in the Subdivision entitled “Blocks 22 to 28 Inclusive and Outlots “A” to “R” Inclusive to the Town of Wabasso”, in the City of Wabasso, Redwood County, Minnesota.

RURAL SERVICE DISTRICT E: A strip of land 100 feet wide, more or less, being 50 feet more or less on each side of the center line of the railroad being the Chicago and Northwestern Railway Company as the same, located and staked out and being across the following described tract of land: The Northeast Quarter (NE ¼) of the Northeast Quarter (NE ¼), Section Twenty Six (26), Township One Hundred Eleven (111), Range Thirty Seven (37) said description being contained in a certain DEED dated August, 296, 1901 and filed for record on October 26, 1901, in Book 47 of DEEDS, Page 202, Register of Deeds, Redwood County, Minnesota; AND All that part of the Northeast Quarter (NE ¼) of the Northeast Quarter (NE ¼) of Section Twenty Six (26), Township One Hundred Eleven (111) North, Range  Thirty six (36) West, which lies Northerly of and parallel 50 feet from the center line of the railroad (now abandoned) over and across said land, EXCEPTING THEREFROM the following described tract: Commencing at the Northeast Corner of said Northeast Quarter (NE ¼) thence North 90 degrees 00 minutes 00 seconds West, assumed bearing, along the North line of said Northeast Quarter (NE ¼) 515.71 feet; thence South 1 degree 17 minutes 53 seconds East parallel with the East  line of said Northeast Quarter (NE ¼) 300 feet; thence North 90 degrees 00 minutes 00 seconds East parallel with the said North line 515.71 feet to the East line of said Northeast Quarter (NE ¼); thence North 1 degree 17 minutes 53 seconds West along the East line of said Northeast Quarter (NE ¼) 300 feet to the point of beginning; AND EXCEPTING THEREFROM Commencing at the Northwest Corner of said Northeast Quarter (NE ¼) of the Northeast Quarter (NE ¼) of Section Twenty six (26), Township One Hundred Eleven (111) Range Thirty Seven (37), thence East along the North line of Section Twenty Six (26) a distance of 3000 feet, thence South a distance of 175 feet, thence East a distance of 100 feet, thence South a distance of 175 feet, thence East a distance of 100 feet, thence South a distance of 125 feet, thence West a distance of 400 feet, thence North a distance of 300 feet to the point of beginning; AND EXCEPTING THEREFROM Commencing at a point 300 feet East of the Northwest Corner of the said Northeast Quarter (NE ¼) of Section Twenty Six (26), Township One Hundred Eleven (111), Range Thirty Seven (37), thence South a distance of 175 feet, thence East a distance of 100 feet, thence North a distance of 175 feet, thence West a distance of 100 feet to the point of beginning.

            Section 5.  Transfer of Land From one District to Another. Whenever any parcel of land included in the Rural Service District is platted in whole or in part; or whenever application is made for construction of a commercial, industrial, residential or agricultural building or improvement; or whenever such improvement or building is commenced without a permit the governing body shall make and enter an order by resolution transferring such parcel or part thereof from the Rural Service District to the Urban Service District. No parcel shall be included in a Rural Service District of five acres or less and no parcel shall remain in a Rural Service District unless such parcel consists of 5 acres of more.

            Section 6.  Ratio of Benefits.

            In the judgement of the City Council, the ratio which exists between the benefits resulting from the tax supported municipal service to parcels in the Rural Service District is Thirty percent (30%), plus any municipal property taxes levied for payment of bonds, and judgements, and interest thereon.

            Section 7.  Regulations Generally.

  1. No city service beyond that normally provided by the townships of Redwood County will be provided by the City in a Rural Service District, except fire, policy and planning services;
  2. Land in a Rural Service District must be open, rural in character and maintained in farm crops or seeded ;
  3. Grading is not considered as development provided grading is such as to hold storm runoff on the land and not produce storm runoff problems  and provided graded areas are cropped or seeded within one year;
  4. Any fill hauled in shall be graded off and seeded at least once each year.
