Ordinance No. 100 – Licensing of Plumbers

AN ORDINANCE PROVIDING FOR THE LICENSING OF PLUMBERS RELATING TO SEWER AND WATER SERVICE IN THE VILLAGE OF WABASSO AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF

Section 1.

For the purpose of this ordinance the term “plumbing” is defined to mean engaging in or conducting the business of constructing and installing systems and the components thereof for drainage of sanitary sewage and wastes from houses, business places, and other establishments and facilities into the Village sewage system and the doing of any act or thing in connection with the introduction of water from the village water works into any house, business place, or other establishment or facility including the installation of pipes, fixtures, fittings and appliances therein.

Section 2.

No person, firm or corporation shall engage in the business of plumbing as herein defined in the Village of Wabasso without having first procured a license therefor from the Village Council. Application for such license shall be made setting forth the name or names of the person or persons who will perform the work, the qualifications of such person or persons and shall be signed by the owner or one of the owners of such business of his, their or its duly authorized agent. The fee for such license shall be $10.00 per calendar year or portion thereof and shall accompany such application. All licenses shall expire on December 31 of each year. No refund of such license fee or any portion shall be made in the event of a cancellation or surrender of such license. Licenses shall be granted and may be cancelled by the Village Council for failure to comply with, violation of, provisions of this ordinance.

Section 3.

No person shall make any sewer or water connection, either directly or indirectly, to the Village sewer or water mains without having first procured a permit therefor from the Water Waorks Committee of the Village Council. Application for such permit shall be made by the owner of the premises seeking to utilize the Village sewer or water main to said council setting forth the description of the premises to be served, the type of service desired, the proposed location of the connection to the Village sewer or water main and the time when it is proposed to make such connection. Such application shall be made except by a licensed plumber under the direction and supervision of the water works committee.

Section 4.

In addition to the permit fee of $2.00 required by Section 3 hereof the applicant shall eposit with the Village Treasurer a cash bond in the amount of either $25.00 when excavation for a service line requires the cutting of a gravel street, or $50.00 in the case of a black topped street, to guarantee replacement of the surface street to substantially it’s original condition. It shall be the obligation of the applicant to so restore such street and upon approval of such restoration b y the Water Works Committee the said deposit shall be refunded. If the applicant fails to so restore such street within five days after notice so to do by the Water Works Committee the said deposit shall be forfeited to the village.

Section 5.

The obligation to repair and maintain sewer and water service connections both in the streets and on private property , shall be the obligation of the owner of the premises served thereby and the same application, permit fee, deposit and provisions shall apply as in the case of a connection to the village sewer or water-mains as set forth in section 4 hereof where such repair or maintenance requires a cutting of the gravel or black topped street.

Section 6.

Any person, firm, or corporation engaging in the business of plumbing as hereinafter defined without having first obtained a license therefore, or any person, firm, or corporation violating any of the provisions of this ordinance shall upon conviction thereof be guilty of a misdemeanor and shall be punished by a fine of not more than one hundred dollars ($100.00) or by imprisonment in the county jail for not more than ninety (90) days.

Section 7.

This ordinance shall be in effect from and after its passage and publication.

Passed and enacted by the Village Council of the Village of Wabasso June 7, 1958.
